Property Held in a Trust

An eligible trust can hold title to a conventionally financed property; trust ownership is not automatically a title problem.

Fannie revocable trust

Fannie accepts eligible inter vivos revocable trusts as mortgagors for all transaction types. At least one individual establishing the trust must be underwritten as a borrower, and principal-residence occupancy requirements still apply.

Freddie living trust

Freddie also permits an eligible Living Trust borrower when its settlor, trustee, revocability, underwriting, title and documentation requirements are met.

Land trusts

Freddie has a separate Land Trust framework in states that recognize land trusts; at least one beneficiary must be a fully underwritten borrower.

Refinance nuance: Fannie may count eligible revocable-trust ownership history toward the six-month cash-out ownership requirement when the borrower is the primary beneficiary.
